M/s Atria Convergence Technologies Limited (ACT) provides Gaming packs Services to its Subscribers which are subject to the below Terms & Conditions. ACT reserves the right to change, modify and amend the Terms at any time without Notice to its Subscribers.

TERMS AND CONDITIONS OF THE OFFER

• ACT Subscriber is eligible to subscribe to any of the ACT Gaming packs as a Value-Added Service (VAS) on any of the ACT Fibernet tariff plans of ACT. The details of the various gaming Packs and the tariff plan details are available on www.actcorp.in/internet-for-streaming/internent-for-gaming
• ACT Subscriber can subscribe to ACT Gaming Packs by visiting our website www.actcorp.in/internet-for-streaming/internent-for-gaming or through our mobile application.
• The subscription charges for various Gaming Packs shall be fixed by ACT. ACT reserves the right to change its subscription charges at its sole discretion.
• Any ACT Subscriber may subscribe to gaming packs for the first time by paying the subscription charges in advance for the period he proposes to subscribe. The first charge for the gaming pack will be made in advance and subsequent charges shall be invoiced through the ACT Fibernet invoices which shall contain subscription charges and Gaming Packs charges separately in the same billing cycle.
• Once subscribed by the ACT Subscriber, the gaming pack may take up to 2 working days from the date of payment to be activated. However, the validity of the gaming pack shall commence only from the date of activation.
• ACT Fibernet Invoices are based on Calendar Month. The Gaming Packs shall be valid for a period 30 days from the date of subscription or renewal. Any Gaming Pack subscribed for a particular month cannot be carried forward to next month and shall expire at the end of its validity period.
• The vouchers or offers or codes provided by ACT as part of its Gaming Pack shall be used by the subscriber only for personal use and he/she shall not resell, share, distribute the same.
• ACT reserves its right to discontinue the Gaming Packs at any point in time. However, any subscription made by any of the Subscribers prior to such discontinuation of Gaming Packs by ACT shall continue to remain valid until its validity period.
• Any code or vouchers provided by ACT in tie up with any 3rd Party may be redeemable only once or may function only upon subscriber making some minimum purchases or basis any other eligibility criteria the concerned 3rd party service provider may define. Hence the Subscriber hereby agrees and acknowledges that any additional offers/vouchers/codes provided by ACT as part of its Gaming packs are being provided on ‘as is' basis and the subscribers are requested to visit concerned 3rd party’s T&Cs on the gaming page or ACT’s mobile application to know more about the terms of use.
• Any complaint or grievance with respect to the said vouchers or any additional services/offers bundled and offered by ACT as part of its Gaming Pack shall be taken up with the customer care of the respective service provider/partner. ACT shall be responsible only with respect to the internet broadband services provided.
• With regards to the “Speed Boost” benefit made available as part of the Gaming Pack, the Subscribers acknowledge that the application of this benefit is subject to Subscriber hardware being capable of availing this benefit including but not limited to router/PC/mobile or any other system model, make, condition, and capability. ACT shall not be liable in any manner whatsoever in case of Subscriber’s router/PC/mobile or any other system not having the necessary capability to receive such speed boost or any other benefit conferred as part of the gaming Pack.
• In case of ACT identifying that any subscriber who had subscribed to ACT Gaming Pack are not in the latest upgraded network infrastructure of ACT, ACT shall on its part, make all efforts to ensure that all Gaming pack Subscribers are upgraded to the latest infrastructure within 5 working days from the date of subscription to the gaming pack by the respective Subscriber. any benefit or Speed boosts applied during this network upgrade period shall apply or activated only from the date of completion of network upgrade by ACT.
• Notwithstanding the anything stated under these terms and conditions, the subscriber agrees and acknowledges that the sole and exclusive remedy available to him/her in case of failure by ACT to provide the network upgrade or any of the benefits under this Gaming Pack is to seek refund of the subscription charges paid by him/her for such Gaming Pack and ACT shall not be liable for any other direct, indirect, incidental and consequential damages in any manner whatsoever.
• “Speed Boost” and “Data Boost” shall be added manually by Subscribers each month/during the tenure of the subscription as applicable, failing which the benefits for the month/tenure will expire in due time/period of the subscription and the same shall not be carried forward to subsequent months.
• Subscribers agree that the frequency of issue of vouchers from 3rd party partners and validity of these vouchers vary depending on partner and can be modified by partners without prior notice to Subscribers
• Subscriber agree that the “Gaming Packs” also called as “A-Game Basic”, “A-Game Ultra”, “A-Game Basic 1 Month”, “A-Game Ultra 6 Months” and variants thereof are subscription services with recurring billing cycles to be renewed upon the completion of the subscription tenure defined within the packs. Subscribers agree that these packs will be added to subsequent bills unless the Subscriber explicitly unsubscribes by calling ACT call center 15 days before the expiry of such Gaming Packs.
• Subscribers agree that the recurring benefits on the pack as detailed on the website will be credited on the anniversary date of subscription to the pack
• Subscribers agree that the billing of these packs will be for the period of 1st to 30th/31st of each month as applicable and shall be due and payable along with the Subscribers broadband billing cycle against which the pack has been subscribed.
• Any disputes shall be settled by mutual discussions, failing which the same shall be referred to Arbitration governed by Arbitration and conciliation Act, 1996 as amended from time to time. The Arbitration shall be conducted by a single Arbitrator appointed by ACT. The Language of arbitration shall be English, and the place of arbitration shall be Bangalore, India.
• Subject to clause 19 herein above, this offer shall be governed by Laws of India and courts at Bangalore shall have exclusive jurisdiction.
