M/s Atria Convergence Technologies Limited (ACT) provides Netflix Services to its Users/Subscribers which are subject to the below Terms & Conditions. ACT reserves the right to change, modify and amend these Terms and Conditions at any time without Notice to Users/Subscribers and we request you to visit our website www.actcorp.in for further details and offers, if any, in this regard from time to time.
The Term ACT User, customer, subscriber, you, may be used interchangeably and shall denote the customers of ACT.
TERMS AND CONDITIONS OF THE OFFER:
- Any subscriber of ACT services shall be eligible to subscribe for Netflix basic as a value-added service upon he/she subscribing to any of the select tariff plans made available by ACT in the respective cities where the User resides as more fully detailed in Annexure 1. The Netflix service is provided to you by Netflix Entertainment Services India LLP under the Netflix Terms of Use, which will be provided to you separately. The other services included in the plan are provided by ACT.
- ACT User agrees and understands that monthly Netflix Subscription charges for Netflix basic plan is bundled along with the select tariff plans as detailed in Annexure 1. In case of User choosing to cancel the select tariff plans of ACT in which the Netflix services have been bundled into, the same shall also entail cancellation of Netflix subscription bundled along with such select plans. However, If you link an existing Netflix account to your ACT plan, terminating the plan will not automatically cancel your Netflix membership, and Netflix will automatically resume charging your existing payment method that they have on file once your ACT plan ends. - ACT customer can choose to upgrade to standard or premium plans of Netflix and shall be required to pay the differential amount respectively to ACT.
- All ACT Customers who opt for Netflix plan upgrade, irrespective of their term, need to pay the amount for the upgrade monthly.
- If you already have an existing Netflix account, you can link it to your ACT plan when you activate Netflix as part of your ACT plan. You will continue to be charged separately for any existing Netflix account until you link that account to your ACT plan. For any queries regarding your direct billing or billing details with Netflix for your existing Netflix account please contact Netflix directly.
- In order to enjoy the Netflix service as part of your ACT plan, you will need to activate the Netflix service by completing the Netflix activation process. You will receive instructions on how to activate the Netflix service via email or text message.
- ACT will share the email address registered to your ACT account with Netflix to facilitate your activation of the Netflix service included in your ACT plan. For further information about how ACT handles your personal data, please visit the Privacy Notice available on https://www.actcorp.in/legal/privacy-policy. You can view Netflix’s Privacy Statement on netflix.com/privacy.
- Upgrades: The Netflix Basic Plan is included as part of the ACT – Netflix Bundle plan. In case the Customer chooses to upgrade his/her Netflix plan, ACT shall raise an invoice with respect to differential amount for the upgraded plan, on the first day of every Calendar month and the User shall duly pay the invoice amount within the due date as prescribed under the said Invoice, failing which the ACT Netflix bundled plan shall be suspended until the dues are cleared. ACT reserves the right to downgrade the customer to Netflix Basic Plan. In case of ACT not being able to make available/termination of Netflix Services bundled plans in ACT's network, ACT shall intimate its Users in advance before such disconnection.
- Subject to the terms and conditions prescribed by TRAI, ACT reserves its right to change/modify ACT – Netflix Bundled plans as and when it deems fit. we request you to visit our website www.actcorp.in for further details and offers, if any, in this regard from time to time.
- ACT User hereby agrees that the User shall not make any unauthorized use of the Netflix service. Such use shall constitute an infringement of the copyrights and other intellectual property rights of Netflix, its affiliates and/or its licensors and shall be a violation of these Terms.
- Any complaint with respect to the said services offered by ACT must be registered with the customer care, the details of which are available on www.actcorp.in.
- Any disputes shall be settled by mutual discussions, failing which the same shall be referred to Arbitration governed by Arbitration and conciliation Act, 1996 as amended from time to time. The Arbitration shall be conducted by a sole Arbitrator appointed by ACT. The Language of arbitration shall be English and the place of arbitration shall be Bangalore, India.
- Subject to clause 13 herein above, this offer shall be governed by Laws of India and courts at Bangalore shall have exclusive jurisdiction.
The User hereby declares that he/she has read contents and be bound by obligations of the above-mentioned Terms and Conditions of Use.
